NAGPUR: The Nagpur bench of Bombay high court on Tuesday issued a notice to Nagpur Improvement Trust (NIT) and Haldiram's International for alleged illegal use of its amusement park near Ambazari lake for marriages and private functions. The respondents were asked to reply before September 5.According to petitioner Sandip Agrawal, NIT had given its 6.4 acres land to Haldiram's on Built Operate and Transfer (BoT) basis for running an amusement and water park at the rate of Rs 12 lakh per year. He, however, contended that the purpose seems to have been defeated since the company is misusing this prime area by providing the park for private functions and weddings. The petitioner, citing a communiquA© by NIT given under Right to Information (RTI) Act, contended that this is resulting in loss of revenue to the Trust. The NIT clarified in the RTI query that Haldiram's wasn't granted permission to provide the area for private parties. Agrawal added that neither the tender nor the agreement contains any clause mentioning use of this land for private functions. In fact, the area should be strictly confined to that of an amusement or a water park.
